Terms of Use

1. What StoriesBy is

StoriesBy lets you record or type a personal message, receive a polished version with an AI-generated illustration, and send it as a digital card. The Service also includes group memory gathering, life story recording, and a public Story Wall (with your consent).

2. Eligibility

You must be at least 16 years old to use StoriesBy. By using the Service, you confirm that you meet this requirement.

3. Your content

You retain ownership of everything you create on StoriesBy — your recordings, text, and photos. By using the Service, you grant us a limited licence to:

• Process your content to provide the Service (transcription, polishing, illustration)
• Store your content to deliver your card to its recipient
• Back up your content for reliability

If you opt in to sharing on the Story Wall or social media, you grant us an additional licence to display that content publicly. You can withdraw this consent at any time by emailing us.

4. AI-generated content

StoriesBy uses AI to polish your text and generate illustrations. AI-generated content may not be perfectly accurate or exactly what you intended. You are responsible for reviewing and editing your polished text before sending. The illustration is generated uniquely for your card but you do not hold exclusive copyright over AI-generated images (this is consistent with current UK and US law).

5. Acceptable use

You agree not to use StoriesBy to:

• Send content that is abusive, threatening, defamatory, or illegal
• Harass, bully, or intimidate any person
• Impersonate someone else or send a card on behalf of someone without their knowledge in a way that could cause harm
• Upload malware or attempt to compromise the Service
• Use automated tools to scrape, spam, or abuse the Service
• Circumvent rate limits or security measures

We reserve the right to remove content or suspend access if these terms are violated.

6. Payments and refunds

Some features of StoriesBy require payment (e.g. paid cards). Payments are processed securely by Stripe. By making a purchase, you agree to Stripe’s terms of service.

Once a card has been created and delivered, we cannot reverse the process. If you experience a technical issue that prevents delivery, contact hello@storiesby.app and we will resolve it or issue a refund at our discretion.

7. Card delivery

Cards are delivered via a unique link. We provide multiple ways to share this link (WhatsApp, email, copy). We are not responsible for delivery failures caused by incorrect contact details, spam filters, or the recipient’s device or network. Card links remain active indefinitely, but we reserve the right to archive inactive cards after 24 months.

8. Intellectual property

The StoriesBy name, logo, design, and code are the intellectual property of JOCH Ltd. You may not copy, modify, or redistribute any part of the Service without our written permission. This does not affect your ownership of your own content (see Section 3).

9. Limitation of liability

StoriesBy is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
• Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose
• We do not guarantee uninterrupted or error-free service
• We are not responsible for the accuracy of AI-generated text or illustrations

Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless JOCH Ltd from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

11. Termination

We may suspend or terminate your access to StoriesBy at any time if you violate these terms. You may stop using the Service at any time. On termination, your content remains available to card recipients unless you request deletion.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer protection laws in your jurisdiction provide otherwise.

13. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the app or email. Continued use of the Service after changes constitutes acceptance of the updated terms.
